{"id":5333,"date":"2017-10-20T04:45:37","date_gmt":"2017-10-20T04:45:37","guid":{"rendered":"http:\/\/iamaw16.ca\/?p=5333"},"modified":"2017-10-20T04:54:48","modified_gmt":"2017-10-20T04:54:48","slug":"district-140-gardaworld-toronto-based-members-spm-organizing-campaign","status":"publish","type":"post","link":"https:\/\/iamaw16.ca\/?p=5333","title":{"rendered":"DISTRICT 140 &#8211; GARDAWORLD TORONTO BASED MEMBERS &#8211; SPM ORGANIZING CAMPAIGN \/ GARDAWORLD ET EN POSTE \u00c0 TORONTO CAMPAGNE DE SYNDICALISATION DES GPC"},"content":{"rendered":"<h1 style=\"text-align: center;\"><strong>SPM ORGANIZING CAMPAIGN<\/strong><\/h1>\n<p>Dear Brothers and Sisters,<\/p>\n<p>As you may be aware, the IAMAW is in the process of unionizing the GardaWorld SPMs working at the Toronto Airports, following decisions by the Canadian Industrial Relations Board (CIRB) which has already recognized this group of employees as appropriate for unionization in previous Organizing Campaigns that took place at the Vancouver and Winnipeg airports.<\/p>\n<p>Unfortunately, it appeared to the IAMAW that the employer was retaliating against this organizing campaign. As such your Union initiated legal proceedings against GardaWorld. Following legal submissions filed by both parties (the IAMAW &amp; GardaWorld) the CIRB issued the following Interim Order on October 18, 2017:<\/p>\n<p>WHEREAS the International Association of Machinists and Aerospace Workers (the applicant union) filed an application for certification on September 13 2017, seeking to represent a unit of Screening Point Managers at the Lester B. Pearson International Airport in Toronto, Ontario;<\/p>\n<p>AND WHEREAS the Canada Industrial Relations Board (the Board) has received a complaint from the applicant union pursuant to section 97(1) of the Canada Labour Code (Par 1-Industrial Relations) (the Code) alleging that Garda Security Screening Inc. has violated sections 94(1), (3)(a), (3)(e) and 96 of the Code;<\/p>\n<p>AND WHEREAS the Board has received a complaint from Garda Security Screening Inc. pursuant to section 97(1) of the Code alleging that the International Association of Machinists and Aerospace Workers has violated section 95(d) of the Code;<\/p>\n<p>AND WHEREAS, the applicant union has also requested that the Board issue an interim order pursuant to section 19.1 of the Code to implement certain interim measures pending the determination of the merits of the complaints;<\/p>\n<p>AND WHEREAS, the Board provided the parties with an opportunity to file full submissions and arguments on the request for an interim order;<\/p>\n<p>AND WHEREAS, the Board, following consideration of the submissions of the parties concerned has determined that interim relief is necessary in order to ensure the fulfillment of the objectives of Code;<\/p>\n<p>NOW, THEREFORE, the Board, pursuant to its powers under section 19.1 of the Code, makes<br \/>\nthe following interim orders:<\/p>\n<p>(i) Garda Security Screening Inc. is to immediately reinstate Barrington Barnett, Elie<br \/>\nGermeil, Michael John and Christopher Hasan to employment with the same terms and<br \/>\nconditions that were in place prior to their termination or suspension until the Board makes a determination on the merits of the complaints;<\/p>\n<p>(2) Garda Security Screening Inc. is to rescind its notice instructing employees not to deal<br \/>\nwith Barrington Barnett in his capacity as an elected representative of the International<br \/>\nAssociation of Machinists and Aerospace Workers for the certified bargaining unit of<br \/>\nscreening officers;<\/p>\n<p>(3) Garda Security Screening Inc. is to post a copy of the attached notice (Appendix A) in a<br \/>\nconspicuous place at its establishment where it is most likely to come to the attention of<br \/>\nScreening Point Managers working for employer.<\/p>\n<p>The Notice that Garda is required to post includes the following statements:<\/p>\n<p>Every employee is free to join the trade union of their choice and to participate in its lawful activities.<\/p>\n<p>Employees have the right not to be discriminated against or be penalized by an employer because they seek to exercise rights under the Code.<\/p>\n<p>The Board has an extensive remedial authority to counteract violations of the Code if it finds that there is merit to the unfair labour practice complaints filed with the Board.<\/p>\n<p>I ask that our Garda Members stand in solidarity and support the SPMs in their right to join our GREAT UNION.<br \/>\nIn Solidarity,<\/p>\n<p>Fred Hospes, President &amp; Directing General Chairperson<br \/>\nTransportation District 140, IAMAW<\/p>\n<p><a href=\"https:\/\/iamaw16.ca\/wp-content\/uploads\/2017\/10\/BULLETIN-062-GARDAWORLD-Toronto-Based-Members-SPM-Organizing-Campaign-October-19-2017-English.pdf\">https:\/\/iamaw16.ca\/wp-content\/uploads\/2017\/10\/BULLETIN-062-GARDAWORLD-Toronto-Based-Members-SPM-Organizing-Campaign-October-19-2017-English.pdf<\/a><\/p>\n<p>&nbsp;<\/p>\n<h1 style=\"text-align: center;\"><strong>CAMPAGNE DE SYNDICALISATION DES GPC<\/strong><\/h1>\n<p style=\"text-align: left;\">Ch\u00e8res consoeurs, chers confr\u00e8res,<\/p>\n<p style=\"text-align: left;\">Comme vous le savez peut-\u00eatre, l\u2019AIMTA est en processus de syndiquer les gestionnaires de points de contr\u00f4le (GPC) en poste aux a\u00e9roports de Toronto, \u00e0 la suite de d\u00e9cisions rendues par le Conseil canadien des relations industrielles (CCRI), lequel a d\u00e9j\u00e0 statu\u00e9 que ce groupe d\u2019employ\u00e9s \u00e9tait habile \u00e0 se syndiquer au terme de campagnes de syndicalisation ant\u00e9rieures tenues aux a\u00e9roports de Vancouver et de Winnipeg.<\/p>\n<p style=\"text-align: left;\">Malheureusement, l\u2019AIMTA \u00e9tait d\u2019avis que l\u2019employeur exer\u00e7ait des repr\u00e9sailles contre cette campagne de syndicalisation. Par cons\u00e9quent, votre syndicat a intent\u00e9 une action contre GardaWorld. \u00c0 la suite du d\u00e9p\u00f4t des observations juridiques par les deux parties (l\u2019AIM et GardaWorld), le CCRI a rendu l\u2019ordonnance provisoire suivant le 18 octobre 2017<\/p>\n<p style=\"text-align: left;\">ATTENDU QUE l\u2019Association internationale des machinistes et des travailleurs et travailleuses de l\u2019a\u00e9rospatiale (le syndicat requ\u00e9rant) a d\u00e9pos\u00e9 une demande d\u2019accr\u00e9ditation le 13 septembre 2017 afin de repr\u00e9senter une unit\u00e9 de gestionnaires de points de contr\u00f4le \u00e0 l\u2019a\u00e9roport international Lester B. Pearson de Toronto (Ontario);<\/p>\n<p style=\"text-align: left;\">ATTENDU QUE le Conseil canadien des relations industrielles (le Conseil) a \u00e9t\u00e9 saisi d\u2019une plainte d\u00e9pos\u00e9e par le syndicat requ\u00e9rant en vertu de l\u2019article 97(1) du Code canadien du travail (PARTIE I \u2013 Relations du travail), dans laquelle elle pr\u00e9tendait que Garda Security Screening Inc. avait enfreint les articles 94(1), (3)(a), (3)(e) et 96 du Code;<\/p>\n<p style=\"text-align: left;\">ATTENDU QUE le Conseil a \u00e9t\u00e9 saisi d\u2019une plainte d\u00e9pos\u00e9e par Garda Security Screening Inc. en vertu de l\u2019article 97(1) du Code, dans laquelle elle pr\u00e9tendait que l\u2019Association internationale des machinistes et des travailleurs et travailleuses de l\u2019a\u00e9rospatiale avait enfreint l\u2019article 95(d) du Code;<\/p>\n<p style=\"text-align: left;\">ATTENDU QUE le syndicat requ\u00e9rant a aussi demand\u00e9 au Conseil de rendre une ordonnance provisoire en vertu de l\u2019article 19.1 du Code autorisant la prise de certaines mesures provisoires en attente des d\u00e9cisions sur le bien-fond\u00e9 des plaintes;<\/p>\n<p style=\"text-align: left;\">ATTENDU QUE le Conseil a permis aux parties de pr\u00e9senter l\u2019ensemble de leurs observations et leurs arguments concernant la demande d\u2019ordonnance provisoire;<\/p>\n<p style=\"text-align: left;\">ATTENDU QUE le Conseil, apr\u00e8s avoir examin\u00e9 les observations des parties concern\u00e9es, est arriv\u00e9 \u00e0 la conclusion qu\u2019une mesure provisoire est n\u00e9cessaire pour assurer le respect des objectifs du Code;<\/p>\n<p style=\"text-align: left;\">IL EST DONC R\u00c9SOLU QUE le Conseil, en vertu des pouvoirs que lui conf\u00e8re l\u2019article 19.1 du Code, rende les ordonnances provisoires suivantes :<\/p>\n<p style=\"text-align: left;\">(i) Garda Security Screening Inc. doit imm\u00e9diatement r\u00e9int\u00e9grer Barrington Barnett, Elie<br \/>\nGermeil, Michael John et Christopher Hasan dans leurs fonctions aux m\u00eames modalit\u00e9s<br \/>\nque celles qui \u00e9taient en place avant leur cong\u00e9diement ou leur suspension, et ce,<br \/>\njusqu\u2019\u00e0 ce que le Conseil rende sa d\u00e9cision sur le bien-fond\u00e9 des plaintes;<\/p>\n<p style=\"text-align: left;\">(2) Garda Security Screening Inc. doit annuler son avis dans lequel il est ordonn\u00e9 aux<br \/>\nemploy\u00e9s de ne pas traiter avec Barrington Barnett en sa qualit\u00e9 de repr\u00e9sentant \u00e9lu de<br \/>\nl\u2019Association internationale des machinistes et des travailleurs et travailleuses de<br \/>\nl\u2019a\u00e9rospatiale pour l\u2019unit\u00e9 de n\u00e9gociation accr\u00e9dit\u00e9e pour repr\u00e9sentant les agents de<br \/>\ncontr\u00f4le;<\/p>\n<p style=\"text-align: left;\">(3) Garda Security Screening Inc. doit afficher une copie de l\u2019avis annex\u00e9 (Annexe A) \u00e0<br \/>\nun endroit apparent dans son \u00e9tablissement, o\u00f9 il est le plus susceptible d\u2019\u00eatre port\u00e9 \u00e0<br \/>\nl\u2019attention des gestionnaires de points de contr\u00f4le qui travaillent pour l\u2019employeur.<\/p>\n<p style=\"text-align: left;\">L\u2019avis que doit afficher Garda comprend les directives suivantes :<\/p>\n<p style=\"text-align: left;\">Tous les employ\u00e9s sont libres d\u2019adh\u00e9rer au syndicat de leur choix et de participer \u00e0 ses activit\u00e9s l\u00e9gitimes.<\/p>\n<p style=\"text-align: left;\">Les employ\u00e9s ont le droit de ne pas faire l\u2019objet de discrimination et de ne pas \u00eatre p\u00e9nalis\u00e9s par in employeur parce qu\u2019ils cherchent \u00e0 exercer leurs droits en vertu du Code.<\/p>\n<p style=\"text-align: left;\">Le Conseil est investi d\u2019une autorit\u00e9 \u00e9tendue en cas de violation du Code s\u2019il juge fond\u00e9e une plainte de pratique d\u00e9loyale du travail dont il est saisi.<\/p>\n<p style=\"text-align: left;\">Je demande \u00e0 nos membres \u00e0 l\u2019emploi de Garda de faire preuve de solidarit\u00e9 et de soutien \u00e0 l\u2019endroit des GPC qui exercent
