It says that Air Canada&#8217;s articles of continuance must contain provisions requiring the Corporation &#8220;to maintain operational and overhaul centres in the City of Winnipeg, the Montreal Urban Community and the City of Mississauga&#8221;.<\/p>\n<p>In 2009, when Air Canada took overhaul work away from its own employees, the IAMAW launched Court litigation under the ACPPA. The Court told us that Air Canada was not in violation of the Act because its overhaul work was still being carried out under contract with Aveos in the required locations. It also told the Union that we had no standing to bring the application.<\/p>\n<p>When Aveos shut down and the work started to leave, the IAMAW went to the provincial governments and urged them to come forward to file cases and hold Air Canada to the law. The governments of Quebec and Manitoba did just that.<\/p>\n<p>On February 4, 2013 the Attorney General of Quebec won the case. It had the support of the Attorney General of Manitoba who appeared as an intervenor, as well as the support of your Union, which provided evidence and witnesses for the case.<\/p>\n<p>Air Canada chose to appeal this decision.<\/p>\n<p>On November 3, 2015 the Quebec Court of Appeal rejected Air Canada&#8217;s appeal and upheld the ruling that Air Canada is in contravention of its obligations under the Air Canada Public Participation Act.<\/p>\n<p>Air Canada has said today that it is reviewing whether to ask the Supreme Court of Canada to intervene to overturn this ruling.<\/p>\n<p>The IAMAW will continue to work with all parties in its long fight to bring this work back where it belongs.<\/p>\n<p>In Solidarity,<\/p>\n<p>Fred Hospes<\/p>\n<p>President and Directing General Chairperson<\/p>\n<p>Transportation District Lodge 140, IAMAW<\/p>\n<p><a href=\"https:\/\/iamaw16.ca\/wp-content\/uploads\/2015\/11\/Bulletin064_EN.pdf\">https:\/\/iamaw16.ca\/wp-content\/uploads\/2015\/11\/Bulletin064_EN.pdf<\/a><\/p>\n<h1 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong>AIR CANADA \/ AVEOS<\/strong><\/span><\/h1>\n<h1 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><strong><span style=\"font-size: x-large;\">LA COUR D\u2019APPEL DU QU\u00c9BEC REJETTE L\u2019APPEL D\u2019AIR CANADA ET CONFIRME QUE CELLE-CI A VIOL\u00c9 LA <\/span><\/strong><i><span style=\"font-size: x-large;\"><span style=\"font-family: Arial; font-size: x-large;\"><strong>LOI SUR LA PARTICIPATION PUBLIQUE AU CAPITAL D\u2019AIR CANADA<\/strong> <\/span><\/span><\/i><\/span><\/h1>\n<p>Chers confr\u00e8res,<\/p>\n<p>Ch\u00e8res consoeurs,<\/p>\n<p><span style=\"font-size: medium;\"><span style=\"font-family: Arial; font-size: medium;\">L\u2019AIMTA tient \u00e0 remercier \u00e0 nouveau les gouvernements du Qu\u00e9bec et du Manitoba d\u2019\u00eatre all\u00e9s de l\u2019avant et d\u2019avoir travaill\u00e9 \u00e0 ses c\u00f4t\u00e9s pour faire respecter la <\/span><\/span><i><span style=\"font-size: medium;\"><span style=\"font-family: Arial; font-size: medium;\">Loi sur la participation publique au capital d\u2019Air Canada <\/span><\/span><\/i><span style=\"font-size: medium;\"><span style=\"font-family: Arial; font-size: medium;\">(la Loi) apr\u00e8s la fermeture d\u2019Aveos en 2012. <\/span><\/span><\/p>\n<p>Lors de la privatisation d\u2019Air Canada, cette loi avait \u00e9t\u00e9 adopt\u00e9e dans le but de prot\u00e9ger le public canadien. Notamment, cette loi dit que les clauses de prorogation de la soci\u00e9t\u00e9 a\u00e9rienne \u00ab comportent obligatoirement des dispositions l\u2019obligeant \u00e0 maintenir les centres d\u2019entretien et de r\u00e9vision dans les villes de Winnipeg et Mississauga et dans la Communaut\u00e9 urbaine de Montr\u00e9al \u00bb.<\/p>\n<p>En 2009, lorsqu\u2019Air Canada avait retir\u00e9 le travail de r\u00e9vision \u00e0 ses propres employ\u00e9s, l\u2019AIMTA avait entrepris des d\u00e9marches devant les tribunaux en vertu de la Loi. Les tribunaux nous avaient alors inform\u00e9s que la soci\u00e9t\u00e9 a\u00e9rienne n\u2019avait pas enfreint la Loi parce que le travail de r\u00e9vision \u00e9tait toujours effectu\u00e9 \u00e0 contrat par Aveos dans les lieux exig\u00e9s. Ils nous avaient \u00e9galement dit que l\u2019AIMTA n\u2019avait pas qualit\u00e9 pour agir.<\/p>\n<p>Lorsqu\u2019Aveos avait ferm\u00e9 ses portes et qu\u2019Air Canada avait entrepris d\u2019envoyer le travail ailleurs, l\u2019AIMTA s\u2019\u00e9tait tourn\u00e9 vers les gouvernements provinciaux en les incitant \u00e0 d\u00e9poser des plaintes et \u00e0 demander \u00e0 la compagnie de respecter la Loi. Et c\u2019est pr\u00e9cis\u00e9ment ce que les gouvernements du Qu\u00e9bec et du Manitoba avaient fait.<\/p>\n<p>Le 4 f\u00e9vrier 2013, le procureur g\u00e9n\u00e9ral du Qu\u00e9bec avait gagn\u00e9 le proc\u00e8s.
