Bill C-525 is critically flawed, as the Conservative dominated Senate&#8217;s Legal and Constitutional Affairs committee discovered last week. Ignoring Liberal amendments to fix the mistakes, the committee passed it on the grounds that amending the Bill would kill it. The Bill then returned to the Chamber for Third Reading on Monday evening, only to be passed, mistakes and all.<\/p>\n<p>This Bill, which will make it harder for workers to certify a union and easier to decertify unions in federally-regulated industries, was introduced by the Conservatives through the back door. MP Blaine Calkins&#8217; introduced this private members bill to amend the Canada Labour rather than following the decades old and proven process of amending the Canada Labour Code through tripartite consultation with employers, labour and government.<\/p>\n<p>Neither employers nor unions sought these changes; neither employers nor unions identified a single problem in current industrial relations that required these legislative amendments. Virtually all industrial relations authorities in Canada have warned against Bill C-525 and the process through which the government is upsetting the balance in federal labour relations.<\/p>\n<p>Even the Canada Industrial Relations Board presented a study to the Standing Committee on Human Resources, Skills and Social Development and the Status of Persons with Disabilities earlier this year that revealed the mandatory voting called for in Bill C-525 will result in a 500% increase in costs.<\/p>\n<p>This legislation is really about denying Canadian workers the right to collective bargaining with their employer. It is an invitation to employers to interfere with workers&#8217; democratic right to choose representation, and it will destabilize federal labour relations.<\/p>\n<p>The Canadian Senate has abdicated its responsibility of sober second thought by allowing a technically flawed and badly drafted bill to pass into law.<\/p>\n<p>In Solidarity,<\/p>\n<p>&nbsp;<\/p>\n<p>Hassan Yussuff President<\/p>\n<p>_________________________________________________________________<\/p>\n<p>Bonjour,<\/p>\n<p><strong>Adoption du projet de loi C-525 <\/strong><\/p>\n<p>La d\u00e9mocratie au Canada s\u2019est couverte de honte hier suite \u00e0 l\u2019adoption par le S\u00e9nat du projet de loi C-525, <em>Loi sur le droit de vote des employ\u00e9s<\/em>. Ainsi qu\u2019a pu le constater le Comit\u00e9 s\u00e9natorial des affaires juridiques et constitutionnelles la semaine derni\u00e8re, le projet de loi C-525 contient de graves lacunes. Sans tenir compte des propositions d\u2019amendement du Parti lib\u00e9ral visant \u00e0 en redresser les erreurs, le Comit\u00e9 a adopt\u00e9 le projet de loi au motif qu\u2019y apporter des modifications aurait pour effet de l\u2019enterrer. Le projet de loi a ensuite \u00e9t\u00e9 renvoy\u00e9 \u00e0 la Chambre pour troisi\u00e8me lecture lundi soir o\u00f9 il a \u00e9t\u00e9 adopt\u00e9, erreurs comprises.<\/p>\n<p>Ce projet de loi, qui rendra le processus d\u2019accr\u00e9ditation syndicale beaucoup plus difficile et facilitera la d\u00e9saccr\u00e9ditation d\u2019un syndicat dans le secteur sous comp\u00e9tence f\u00e9d\u00e9rale, a \u00e9t\u00e9 pr\u00e9sent\u00e9 par les conservateurs \u00e0 la d\u00e9rob\u00e9e. Le d\u00e9put\u00e9 Blaine Calkins a pr\u00e9sent\u00e9 ce projet de loi d\u2019initiative parlementaire pour modifier le Code canadien du travail au lieu de suivre le processus \u00e9prouv\u00e9 depuis des dizaines d\u2019ann\u00e9es consistant \u00e0 organiser des consultations tripartites entre employeurs, syndicats et gouvernement.<\/p>\n<p>Ni les employeurs ni les syndicats n\u2019ont r\u00e9clam\u00e9 ces modifications; ni les employeurs ni les syndicats n\u2019ont identifi\u00e9 de probl\u00e8me dans les relations employeurs-travailleurs actuelles justifiant ces modifications l\u00e9gislatives. La vaste majorit\u00e9 des sp\u00e9cialistes canadiens en relations employeurs-travailleurs ont lanc\u00e9 des mises en garde contre les risques inh\u00e9rents \u00e0 l\u2019adoption du projet de loi C-525 et le processus entrepris par le gouvernement pour d\u00e9s\u00e9quilibrer les relations de travail dans le secteur sous comp\u00e9tence f\u00e9d\u00e9rale.<\/p>\n<p>Le Conseil canadien des relations industrielles a m\u00eame pr\u00e9sent\u00e9 une \u00e9tude au Comit\u00e9 permanent des ressources humaines, du d\u00e9veloppement des comp\u00e9tences, du d\u00e9veloppement social et de la condition des personnes handicap\u00e9es de la Chambre des communes montrant que le vote obligatoire propos\u00e9 dans le projet de loi C-525 se traduirait par une augmentation de 500 % des co\u00fbts d\u2019administration.<\/p>\n<p>Ce projet de loi vise en r\u00e9alit\u00e9 \u00e0 d\u00e9pouiller les travailleuses et travailleurs canadiens de leur droit \u00e0 la n\u00e9gociation collective avec l\u2019employeur.
